An acclaimed legal scholar exposes the Supreme Court’s increasing use of unsigned, unexplained orders to change the law—all behind closed doors
The Supreme Court has always had the authority to issue emergency rulings in exceptional circumstances. But since 2017, the Court has dramatically expanded its use of the behind-the-scenes “shadow docket,” regularly making decisions that affect millions of Americans without public hearings and without explanation, through cryptic late-night rulings that leave lawyers—and citizens—scrambling.
The Court’s conservative majority has used the shadow docket to green-light restrictive voting laws and bans on abortion, and to curtail immigration and COVID vaccine mandates. But Americans of all political stripes should be worried about what the shadow docket portends for the rule of law, argues Supreme Court expert Stephen Vladeck. In this rigorous yet accessible book, he issues an urgent call to bring the Court back into the light.

I thought the supreme court’s job, is to make sure any laws made by Congress or states, do not go against your rights as an American citizen, as stated in the Constitution?

The Shadow Docket is used to vet lawsuits that are appealing to the Supreme Court. A ruling in a shadow docket, one way or another, either puts a stay on whatever judgement that came out of an appeals court or allows that judgement to carry on. The shadow dockets do not change any laws since a case only gets to the Supreme Court after a district court has ruled then an appellate court has ruled and, if there are any appellate courts giving differing rulings than the others on what amounts to the same legal argument, that is when they will step in and make a ruling. They are arbitrators of constitutionality, not a traditional court. By the time a, let’s say, voting rights case makes its way to them, two or three (or even four) different courts with different judges have already made rulings and judgments on the case.
Nothing happens in a vacuum. It took the anti-RvW crowd fifty years and hundreds of lawsuits to get to a position where the Supreme Court could finally let them have their way. With many states now legislating bans, the Court’s work on the subject is far from over.

is it only me or is this file corrupted? I haven’t been able to open it.
Thanks for your effort anyways.

Listen to this if you like, but be aware that the author is not an objective legal analyst. His is an activist who would be defending the practices he criticizes if the Left were in the majority.
